Wedding Photography Contract
Retainer Fee
The wedding date shall be reserved through payment of five hundred ($500) dollars which is applied to the base coverage. This fee is non-refundable in the event of cancellation of the wedding or for any other reason and is not applied to any a la carte items. Engagement shoots are paid at the time of service.
Payment of Balance of Fee
Any A La Carte items (engagement shoots/books) that are completed before the wedding date will need to be paid at the time of the delivery. A final payment of the balance of the wedding fee is due one month before the wedding day appointed in this contract. Nate Crouch Photography, LLC is under no obligation to fulfill any part of this contract unless payment is made in full before the wedding date appointed in this contract. No refund of already-paid fees shall be owed to client in any circumstance.
Expenses Incurred
When applicable, the client is responsible for all travel, accommodation, meal and transport costs including parking unless provided by the client.
Travel Expenses
All travel expenses are based on the distance between the event location(s) and Nate Crouch's studio address. For all event(s), the first 50 miles roundtrip of travel are included. All miles in excess of 50 miles roundtrip are charged at $1.00 per mile.
Responsibility
Nate Crouch Photography is not responsible for compromised coverage due to causes beyond the control of Nate Crouch Photography including but not limited to obtrusive guests, lateness of the client or guests, weather conditions, schedule complications, incorrect addresses provided to Nate Crouch Photography, rendering of decorations, or restrictions of the locations. Nate Crouch Photography is not responsible for backgrounds or lighting conditions which may negatively impact or restrict the photo coverage. Nate Crouch Photography is not held liable for missed coverage of any part of the event(s). Nate Crouch Photography will not be held accountable for failure to deliver images of any individuals or any objects at the event(s).
Sales Tax
Nate Crouch Photography, LLC is required to collect 7% sales tax from clients on all products sold within the state of Indiana.
Archiving of Images
The original images files will be archived for a minimum of 10 years after wedding date.
Limit of Liability
Should Nate Crouch Photography, LLC be unable to perform any or all of the duties herein described for any reason, including, but not limited to: technical problems or failure, film or digital equipment problems or failure, transportation problems or failure, processing problems or failure, accident or illness of any agent or employee of Nate Crouch Photography, LLC, or any other reason or cause whatsoever, then the client agrees to hold Nate Crouch Photography, LLC and his agents and/or employees harmless for any damages, causes of action, or claims arising out of non-performance. The client agrees that the sole remedy tor non-performance of this contract shall be limited to a refund of any paid monies hereunder.
Cancellation
If client cancels the wedding photography services for any reason. Nate Crouch Photography, LLC shall be entitled to monies paid up to the date of the cancellation. If Client cancels the wedding photography services one month or less before the wedding date said in this contract. Nate Crouch Photography, LLC is entitled to the entire contracted package fees laid out hereunder.
Substitution of Competent Photographer
Client agrees that in the event of illness, accident or emergency, a competent photographer may be substituted by Nate Crouch Photography, LLC to fulfill the photography obligations of Nate Crouch Photography, LLC.
No Guarantee of Particular Images
Nate Crouch Photography, LLC does not guarantee to capture any particular photo or image, to photograph every person in attendance at the wedding, or to meet any particular aesthetic criteria as part of his performance under this contract.
Copyright
Nate Crouch Photography retains copyright of all images created and will have the right to make reproductions for websites, portfolio samples, self-promotion, and professional competition. All images are released to clients with a photo reprint release and are not to be used for commercial profit without additional written approval from Nate Crouch Photography.
Severability
If any provision of this Agreement is held to be invalid or unenforceable by law, the validity of this Agreement in whole shall not be affected, and the other provisions of the Agreement shall remain in full force and effect.
I hereby affirm that I am over the age of majority and have the right to contract in my own name. I have read the above authorization, release, and agreement prior to its execution and I fully understand the contents thereof. This Agreement shall be binding upon me and my heirs, legal representatives and assigns.
